Terms of Service
These Terms govern access to NIYAM, a field and project operations service owned and operated by TECEADS SOLUTIONS PRIVATE LIMITED. By creating an account, accepting these Terms, or using the service, you agree to them on behalf of yourself and, where applicable, your organisation.
1. The service
NIYAM provides web and mobile workflows for construction site records, daily progress, labour attendance, materials, bills and expenses, approvals, reports, client sharing, communications, subscriptions and related operational administration. Features may vary by plan, role, device, configuration and availability.
NIYAM may improve or change service features while preserving any non-waivable rights and active order commitments that apply to you.
2. Accounts and authority
- You must provide accurate account information and keep it current.
- You are responsible for activity performed through your account and for protecting sign-in codes, devices and session credentials.
- If you use NIYAM for an organisation, you confirm that you are authorised to bind that organisation and manage its workspace.
- Workspace owners and administrators control membership, roles, permissions, project access and certain service settings.
- You must promptly contact support if you suspect unauthorised access or account misuse.
3. Customer content and instructions
You and your organisation retain responsibility for information submitted to the service, including project records, photographs, attendance data, worker and client details, bills, documents, comments and reports (collectively, “Customer Content”).
You grant NIYAM permission to host, copy, process, transmit and display Customer Content only as needed to provide, secure, maintain and support the service, comply with lawful obligations, and follow authorised workspace instructions.
You must have all permissions, notices and lawful grounds required to upload and use Customer Content, especially personal data about workers, clients, vendors and other third parties.
4. Plans, trials, renewals and payment
Plan features, prices, billing cycles, taxes, trial availability and renewal terms are the ones displayed to you in the applicable pricing, checkout, order or subscription interface. Recurring plans continue for the displayed billing cycle until cancelled in accordance with the applicable order terms.
You authorise the applicable payment provider to process charges you approve. Failed, reversed or overdue payments may limit access to paid features after any notice or remedy period required by applicable terms or law.
Subscription cancellation is described in the Cancellation Policy. Refund eligibility and processing are described separately in the Refund Policy. NIYAM is delivered as a digital service as described in the Shipping and Delivery Policy. Nothing in these Terms removes rights that cannot lawfully be excluded.
5. AI-assisted features
NIYAM includes AI-assisted extraction, classification and suggestion workflows. AI output can be incomplete, inaccurate or unsuitable for a particular project. It is not a final approval, professional instruction, safety certification, accounting opinion or legal advice.
You must review source documents and AI output before relying on, approving, sharing or acting on it. Additional details are in the AI Data Use Notice.
6. Acceptable use
You must comply with the Acceptable Use Policy. You may not use NIYAM unlawfully, interfere with its security or availability, access data without authority, distribute malicious code, abuse communications, or use AI features to cause harm or evade human review.
7. Service ownership and feedback
NIYAM is owned and operated by TECEADS SOLUTIONS PRIVATE LIMITED. TECEADS SOLUTIONS PRIVATE LIMITED and its licensors retain rights in the service, software, design, documentation and branding, excluding Customer Content. These Terms give you a limited, non-exclusive, non-transferable right to use the service during your authorised access period.
If you provide feedback, NIYAM may use it to improve the service without transferring ownership of your Customer Content or identifying you publicly without permission.
8. Availability, support and third-party services
NIYAM works with infrastructure, communications, authentication, payment and AI service providers. Their services may be subject to separate terms and availability. Planned maintenance, security response, network conditions and third-party incidents can affect access.
NIYAM will use reasonable operational measures to provide and secure the service, but does not promise uninterrupted or error-free operation. Support is available through the contact details on this page.
9. Suspension and termination
You may stop using the service and request account or subscription cancellation. NIYAM may restrict or suspend access where reasonably necessary to address a security risk, unlawful activity, non-payment, material breach, harm to others or service integrity. Where appropriate, NIYAM will provide notice and an opportunity to remedy the issue.
Provisions that by their nature should survive termination—including payment obligations already incurred, ownership, confidentiality, lawful retention, disclaimers and limitations—continue to apply.
10. Responsibility and applicable law
To the extent permitted by applicable law, each party is responsible for losses it causes through breach, negligence, fraud, wilful misconduct or violation of law. NIYAM is not responsible for decisions made from unreviewed AI output, inaccurate Customer Content, unauthorised workspace instructions, or third-party services outside NIYAM’s control.
Any warranty exclusion or liability limitation applies only to the extent permitted by law and does not exclude liability that cannot legally be excluded. Contact support first so the parties can try to resolve a concern promptly; statutory complaint and dispute rights remain available.
11. Changes to these Terms
Material changes will be communicated through an appropriate service, account or contact channel before they take effect where required. The date at the top identifies the latest published version.
